Seller’s Responsibility:
1. The Seller guarantees the puppy is in good health, is up-to-date on immunizations appropriate for the puppy’s age and has been de-wormed, at the time the Buyer takes possession. The Buyer has three business days to take the puppy to a veterinarian for an examination. If the puppy is found to be in poor health, the Buyer has the option of returning the puppy to the Seller, at Buyer’s cost, for a full refund of the Purchase Price, or keeping the puppy, and the Seller will reimburse for all veterinary costs, up to the Purchase Price, related to treatment of any pre-existing condition. Buyer must contact the seller immediately and supply any requested veterinary records to the Seller. If the puppy is not taken to a licensed veterinarian within the three business days, the Health Warranty is void.
2. The Seller provides this warranty for two years after the date of this Agreement against hip dysplasia, elbow dysplasia, eye conditions that are genetic in origin, von Willabrand’s Disease, and genetic heart disorders that are serious enough to require treatment. In the event the puppy exhibits symptoms of one of these defects, the Buyer must contact the seller immediately and supply any requested veterinary records to the Seller. The Health Warranty expires two years after date of this Agreement.
3. This Health Warranty excludes all other conditions.
4. If it is determined the puppy does have one of the above listed genetic disorders that is identified within two years of the date of this Agreement, the Buyer has the option of: (1) either a replacement puppy from the next available litter, or (2) reimbursement of all veterinary expenses related to the illness up to the Purchase Price of the puppy. Puppy does need not be returned to Seller. Shipping fees will not be refunded, and if it becomes necessary to ship a replacement puppy, those fees are to be paid by the Buyer.
5. If the puppy should die from a suspected congenital defect within 24 months of the date of this Agreement, an autopsy must be performed at the Buyer’s expense by a veterinary teaching hospital or state licensed DVM acceptable to the Seller’s own veterinarian. If the autopsy shows a congenital defect as the reason of the death, the Seller will provide another puppy of equal value to the purchaser. A written statement from the veterinarian must be provided. This warranty is void in the event of an indeterminable or inconclusive diagnosis.
6. This Health Warranty is non-transferable and not assignable by Buyer.
Buyer’s Responsibility:
1. The Buyer agrees to pay the Seller the Purchase Price of $ ______________ (plus applicable sales tax 5.475% if the Buyer picks dog up in MO). This fee does not include shipping, if shipping is required.
2. The Buyer agrees that their Goldendoodle will be housed indoors.
3. The Buyer agrees to feed their Goldendoodle only a quality food.
4. The Buyer agrees to keep their Goldendoodle at a healthy weight.
5. The Buyer agrees to make and keep annual veterinary appointments for their Goldendoodle, keep all immunizations current according to the guidelines of the AVMA and properly administer heartworm preventative if recommended for your area.
6. The Buyer agrees to provide basic obedience training with their Goldendoodle puppy within the first year of owning their dog.
7. The Buyer agrees to postpone strenuous, repetitive exercise until after their Goldendoodle is over one year of age.
8. The Buyer agrees to contact the Seller immediately if the Buyer determines they are unable to keep their Goldendoodle for any reason. The Buyer and Seller will determine how the dog will be re-homed.
9. The Buyer agrees to never place the Goldendoodle in a shelter, pound or similar facilities or research laboratory.
10. The Buyer understands that the money paid for the puppy is non-refundable except in the case of the above described Health Warranty.
11. Buyer agrees to spay or neuter the puppy before it reaches the age of six (6) months and provide proof to Seller and non-compliance will void the Health Warranty.
12. IT WILL BE A VIOALTION OF THIS AGREEMENT FOR BUYER TO BREED THIS PUPPY AND BUYER AGREES TO PAY SELLER LIQUIDATED DAMAGES OF $10,000 PLUS ATTORNEY FEES IN THAT EVENT.
13. Buyer agrees that any dispute of this agreement will be subject to the jurisdiction of the state of Missouri, Greene County.
